Terms of Service
These terms are the agreement between Yallery, Inc. (“Yallery Studio”, “we”) and you, for the use of the Yallery Studio creative workspace at yallerystudio.com (together, “the Service”). By creating an account or generating content you accept them.
1. What the Service is
The Service generates images, video and related media from the ideas, prompts and files you bring to it. You work with it through the Studio workspace and pay for it in credits: a subscription plan brings a monthly allowance of them, and subscribers can buy more. The generation models and their prices in credits, the plans and their limits are published in Studio, and the plans on this site.
We may add, change or retire models. A published model stays available, or stays available under its previous name after a rename; we will not silently point an existing model at a different one.
2. Your account
You must be at least 18 years old and able to enter a contract. You are responsible for what happens under your account, including activity by anyone who obtains your sign-in details. If you believe your sign-in details have leaked, change your password immediately.
We store only a hash of your password, so we cannot recover it for you — a lost password is reset, not retrieved.
3. Money
Plans. Studio is sold as subscription plans, billed monthly or annually in advance, in US dollars. Payments are processed by Stripe; we never see or store your card number. A change of plan takes effect from your next billing period. A new price applies to new subscriptions: a current subscription keeps the price and the credits it was bought with until you change plan.
Credits. Generations are paid for in credits, at the price Studio shows before you generate; 100 credits are worth $1 in every plan. Credits come in three kinds, and Studio spends them in this order:
- Plan credits arrive with every month of a paid plan — an annual plan brings twelve monthly allowances — and last until the next month’s arrive. They do not roll over, and they end with the subscription.
- Free credits — starter credits for a new account, credits we add, and a coupon’s bonus — last 90 days from when they arrive.
- Top-up credits, which subscribers can buy at any time, last 12 months from the purchase and stay through renewals and cancellation.
Failed generations are refunded in full, automatically. If a generation fails on our side, the credits reserved for it return to your balance without you asking.
Refunds. Within 14 days of a payment, if none of the credits it bought have been spent, write to cooperation@yallery.app from the address on the account, or ask through Feedback in Studio, and we will refund the whole payment to the original payment method. Credits that have been spent are not refundable — the compute has been bought and spent. If you dispute a payment with your bank instead, the credits it bought that are still unspent are removed.
Cancelling. You can cancel a subscription at any time. It runs to the end of the period you have paid for and then stops renewing; top-up and free credits stay until they expire.
Coupons work as published with them — a discount on the first payments of a new subscription, or bonus credits with its first payment — once per account.
Prices in credits can change. A change applies to generations started after it is published; it never re-prices a generation you have already made.
4. Your content
You keep every right you had in what you send us. You grant us only the permission we need to run the Service: to receive your inputs, process them, store the results, and deliver them back to you.
We do not use your prompts, inputs or outputs to train models, and we do not show them to anyone. We do not sell them, and we do not use them as examples without asking you first in writing.
You are responsible for having the rights to what you send. Do not upload material you do not have permission to use, and do not use the Service to produce:
- sexual content involving minors, or any material that sexualises a minor;
- content that impersonates a real person in order to deceive, including synthetic media of an identifiable person presented as genuine;
- content intended to harass, threaten or defame a specific person;
- material that infringes someone else’s copyright or trademark;
- anything unlawful where you are, or where the result will be published.
We may refuse or stop a generation request that appears to breach this section, and we may suspend an account that repeatedly does. Where we can, we will tell you why.
5. Availability
We do not offer a service level agreement. The Service runs on GPU capacity we rent, and both capacity and latency vary: a short clip can be ready in seconds when capacity is warm, while the first generation after a quiet period can take a few minutes. Published timings are measurements, not promises.
We will not deliberately break a working project. When something must change, your existing projects keep working.
6. Suspension and ending the agreement
You can stop using the Service and close your account at any time; unused credits are refunded only as section 3 says. We can suspend or close an account for a breach of section 4, for non-payment, or where required by law. If we close an account that has not breached these terms, we refund the unused credits you paid for.
7. Liability
The Service is provided “as is”. Generated output is produced by machine learning models and may be inaccurate, unsuitable for your purpose, or resemble existing material; you are responsible for reviewing it before you use it, and for how you use it.
To the extent the law allows, our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose, and we are not liable for indirect or consequential loss, lost profit, or lost data.
Nothing here limits liability that cannot be limited by law.
8. Changes to these terms
We may update these terms. If a change materially reduces your rights, we will email the address on your account at least 14 days before it takes effect, and you may close the account instead of accepting it — in which case we refund the unused credits you paid for.
9. Law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Before starting any formal proceedings, write to us — most things are settled by an email.
